DepositMark is software operated by DepositMark LLC, a Wyoming limited liability company. It helps a business collect a customer's authorization for a bank check payment, verify the account and prepare the check. By using a DepositMark page you agree to these terms.
What DepositMark is and is not
DepositMark is not a bank, a money transmitter or a payment processor. We do not receive, hold or send money. Each payment is deposited by the business into its own bank account, and the payment is between you and that business.
If you are paying a business
You confirm that you are an owner of, or authorized signer on, the bank account you enter, and that the information you provide is accurate. Your authorization covers the single payment shown on the page. Questions about goods, services, refunds or cancelling a payment should go to the business named on the page.
If you are a business
Use of the DepositMark service by businesses is governed by a separate merchant agreement. You are responsible for obtaining a valid authorization for every payment, for depositing checks under your own bank's rules, and for complying with the laws that apply to your sales.
Your business is your responsibility
DepositMark provides software and check preparation only. Each business that uses DepositMark is solely responsible for its own products, services, advertising, sales practices and refunds, and for complying with the laws that apply to it. DepositMark does not review or endorse what a business sells and is not liable for a business's conduct toward its customers.
Prohibited use
DepositMark may not be used for any unlawful purpose, for sales made by telephone, or to take a payment the account holder has not authorized. We may refuse, suspend or close an account at any time if we believe it is being used this way.
No warranty
DepositMark is provided as is. We do not guarantee that a payment will clear. To the extent the law allows, our liability is limited to the fees paid to us for the service.
Governing law
These terms are governed by the laws of the State of Wyoming, without limiting any consumer protection you are entitled to under the law of the state where you live.
